The NFLPA recently produced a two-page assessment for players entitled ?The Economic Truth About The New NFL CBA.?

On Monday, in separate letters to all players and NFLPA-certified agents, NFLPA president Domonique Foxworth and outside counsel Jeffrey Kessler went into more detail regarding the gains made by players in the new labor deal.

Foxworth?s letter repeats the same bullet points from the two-page document, along with a fourth entry:? ?Elimination of two-days and reduced hitting in practices have provided an immediate benefit to players.?

Also citing the higher Injury Protection Benefit and improved medical standard, Foxworth writes that ?the new CBA was something that was worth fighting for.?

Kessler?s letter is far more detailed, outlining nine arguments aimed at countering ?anti-player critics? who have made ?grossly inaccurate? claims that ?demonstrate a fundamental misunderstanding? of the current CBA and its predecessor.

His points are accurate, even though some of the issues weren?t ever the subject of serious criticism.? For example, Kessler claims that critics believe the current deal is unfair because it reduced the players? share from ??nearly 60%? to an average of 47% during the course of the deal.?? Though we?re aware of no critics who have made that contention, Kessler?s response is accurate.? The prior percentage was applied after the NFL received $1 billion off the top in cost deductions.? The new percentage is much, much closer to a per-dollar formula.

Kessler also points out that the new CBA has minimum cash spending requirements.? Though he doesn?t mention that the per-team minimum of 89 percent doesn?t apply until 2013, he accurately points out that the league-wide minimum is 99 percent in 2011 and 2012, dropping to 95 percent in future years.

Kessler also touts the increase in guaranteed compensation, addresses the belief in some circles that the 55-percent share that goes to the players on national TV and media deal is nevertheless limited by a 47-percent share on all revenue, defends the rookie wage scale, explains that the NFLPA did not surrender group licensing rights to the NFL, and emphasizes the non-economic benefits of the new CBA (such as limited practices, the new Injury Protection Benefit, and other achievements).

Finally, Kessler tackles the contention from a ?select number of ?journalists?? that ?the new CBA is not much better than the proposal the owners made to the players in March of 2011,? calling that claim ?uninformed and wrong.?? He points out that the proposal offered a fixed cap with no upside, along with dramatically reduced TV revenues as of 2014, and that the March 2011 proposal lacked other key player-friendly terms that appeared in the final deal.

Kessler?s letter represents the first detailed effort to respond to criticism of the CBA, but at no point does he or Foxworth address the comments from owners like Robert Kraft that, under the current labor deal, the salary cap won?t increase significantly for the foreseeable future.? The comparisons by ?journalists? like Daniel Kaplan of SportsBusiness Journal and Greg Bedard of the Boston Globe (and, yes, me) of the final CBA to the March 2011 proposal arose directly from projections and calculations regarding the cap dollars under the final deal in comparison to the guaranteed cap dollars under the March 2011 proposal.? Until the claims from influential owners like Kraft and Bob McNair are addressed, Kessler?s letter can?t be regarded as complete, no matter how thorough it may otherwise appear to be.

Dino dismay: Origin of skeleton to be auctioned questioned

The origin of a rare tyrannosaur skeleton, now sitting mounted and prepared at an auction house in New York City, has been questioned, with some saying the specimen is from Mongolia; if so, that would mean it entered the United States illegally.

The rare Tyrannosaurus bataar ? standing 8 feet tall and 24 feet long ? is to be auctioned Sunday by Heritage Auctions.

An email to LiveScience late on Friday afternoon claimed the Mongolian President Elbegdorj Tsakhia was raising concerns that the specimen was actually his country's property. The email contained a note signed by Mark Norell, a vertebrate paleontologist at the American Museum of Natural History in New York City.

"There is no legal mechanism (nor has there been for over 50 years) to remove vertebrate fossil material from Mongolia. These specimens are the patrimony of the Mongolian people and should be in a museum in Mongolia," the letter reads.

Norell confirmed that the letter was his.

"There is nothing from Mongolia that is legal. It's not that I am against the commercial trade of fossils, it's just different countries have different laws," Norell told LiveScience, adding that Heritage Auctions avoids giving the specific locality for the origin of the fossil in their catalog of natural history items to be auctioned.

The description, he said, only states the skeleton is from Central Asia, though if the specimen did indeed come from China, it would still be illegal.

David Herskowitz, director of natural history for Heritage Auctions, said the T. bataar skeleton entered the United States legally, adding in a statement that "no one knows where exactly it was dug up. They'd have to find the hole and match up the matrix."

While the tyrannosaur skeleton is the headliner, several other natural-history specimens are also set to be auctioned Sunday. Of these, Norell says he is also concerned an ankylosaur skull and T. bataar teeth may also be from Mongolia; the teeth described in the auction house's catalog say they came from a formation that Norell says only exists in Mongolia.

Regarding the T. bataar skeleton and the ankylosaur, Norell said, "They say they are from Central Asia, but the only places those two animals have ever been collected have been from Mongolia." [Image Gallery: Dinosaur Fossils]

Heritage Auctions is "the third largest auction house in the country," Norell said. "I am not going to say they are complicit and aware, they are just allowing it to happen and not asking the right questions as far as provenance goes." Essentially they aren't doing their due diligence, according to Norell.

Heritage's Herskowitz said the consignors warranted in writing to Heritage that they held the title to the fossils. It is "curious that Mongolia waited until 48 hours before the auction to make their claim, when the sale has been public for four weeks," Herskowitz said in a statement.

Norell, who has worked in Mongolia for 22 years, sees more of this illegal trading occurring, as it's easier to reach the fossils now with more roads in the Gobi Desert, and the prices for the fossils are going up, he said.

"I am not against the commercial aspect," Norell said. "But it should be done ethically and it should be done legally ... it really doesn't help anybody when it is done his way"

But experts say the government's proposed new surveillance program will gather so much data that spooks won't have to read your messages to guess what you're up to.

The U.K. Home Office stresses it won't be reading the content of every Britons' communications, saying the data it seeks "is NOT the content of any communication." It is, however, looking for information about who's sending the message and to whom, where it's sent from and other details, including a message's length and its format.

The proposal, unveiled last week as part of the government's annual legislative program, is just a draft bill, so it could be modified or scrapped. But if passed in its current form, it would put a huge amount of personal data at the government's disposal, which it could use to deduce a startling amount about Britons' private lives ? from sleep patterns to driving habits or even infidelity.

"We're really entering a whole new phase of analysis based on the data that we can collect," said Gerald Kane, an information systems expert at Boston College. "There is quite a lot you can learn."

The ocean of information is hard to fathom. Britons generate 4 billion hours of voice calls and 130 billion text messages annually, according to industry figures. In 2008, the BBC put the annual number of U.K.-linked emails at around 1 trillion.

Then there are instant messaging services run by companies such as BlackBerry, Internet telephone services such as Skype, chat rooms, and in-game services like those used by World of Warcraft.

Communications service providers, who would log all that back-and-forth, believe the government's program would force them to process petabytes (1 quadrillion bytes) of information every day. It's a mind-boggling amount of data, on the scale of every book, movie and piece of music ever released.

So even without opening emails, how much can British spooks learn about who's sending them?

THEY'LL SEE THE RED FLAGS

If you sent a text from London before stepping behind the wheel, and a second one from a service station outside Manchester three hours later, authorities could infer that you broke the speed limit to cover the roughly 200 miles that separate the two.

Crunching location data and communications patterns gives a remarkably rich view of people's lives ? and their misadventures.

Ken Altshuler, of the American Academy of Matrimonial Lawyers, raves about the benefits smartphones and social media have brought to savvy divorce attorneys. Lawyers don't need sophisticated data mining software to spot evidence of infidelity or hints of hidden wealth when they review phone records or text traffic, he said.

"One name, one phone number that's not on our client's radar, and our curiosity is piqued," he said. The more the communication ? a late-night text sent to a work colleague, an unexplained international phone call ? is out of character, "the more of a red flag we see."

THEY'LL KNOW WHEN YOU'RE SLEEPING

The ebb and flow of electronic communication ?that call to your mother just before bed, that early-morning email to your boss saying you'll be late ? frames our waking lives.

"You can figure somebody's sleep patterns, their weekly pattern of work," said Tony Jebara, a Columbia University expert on artificial intelligence. In 2006, he helped found New York-based Sense Networks, which crunches phone data to do just that.

Jebara said that calls made from the same location from 9 to 5 are a good indication of where a person works; the frequency of email traffic to or from a person's work account is a good hint of his or her work ethic; dramatic changes to a person's electronic routine might suggest a promotion ? or a layoff.

"You can quickly figure out when somebody lost their job," Jebara said, adding: "Credit card companies have been interested in that for a while."

THEY'LL KNOW WHO'S THE BOSS

Drill down, and communication can reveal remarkably rich information. For example, does office worker A answer office worker B's missives within minutes of the message being sent? Does B often leave colleagues' emails unanswered for hours on end? If so, B probably stands for "boss."

That's an example of what Jebara's Columbia colleagues call "automated social hierarchy detection," a technique that can infer who gives the orders, who's respected and who's ignored based purely on whose emails get answered and how quickly. In 2007, they analyzed traffic from the Enron Corporation's email archive to correctly guess the seniority of several top-level managers.

Intelligence agencies may not need such tools to untangle corporate flowcharts, but identifying ringleaders becomes more important when tracking a suspected terrorist cell.

"If you piece together the chain of influence, then you can find the central authority," he said. "You can figure that out without looking at the content."

THEY'LL KNOW WHO YOU'RE TALKING TO

Seeing how networks of people communicate isn't just about finding your boss. It's about figuring out who your friends are.

Programs already exist to determine the density of communications ? something that can identify close groups of friends or family without even knowing who's who. If one user is identified as suspicious, then users closest to him or her might get a second look as well.

"Let's say we find out somebody in the U.K. is a terrorist," said Kane. "You know exactly who he talks to on almost every channel, so BOOM you know his 10 closest contacts. Knowing that information not only allows you to go to his house, but allows you to go to their houses as well."

A SNOOPER'S CHARTER?

Detective work at the stroke of a key is clearly attractive to spy agencies. British officialdom has been pushing for a mass surveillance program for years. But civil libertarians are perturbed, branding the proposal a "snooper's charter."

Kane says the surveillance regime has to be seen in the context of social networks such as Facebook and LinkedIn, where hundreds of millions of people are constantly volunteering information about themselves, their friends, their family and their colleagues.

"There's no sense in getting all Big Brother-ish," he said. "The bottom line is that we're all leaving digital trails, everywhere, all the time. The whole concept of privacy is shifting daily."

Before you do business to business marketing, you should be well aware that the standards of the products and services that you are offering are supposed to be of higher standards than when you are selling to a consumer.
As opposed to business to consumer marketing, under the business to business marketing, you will be focusing on a more targeted market. You will not ignore the consumer in the picture because if the businesses you are targeting is not doing well in as far as the product that it is selling to the consumer is concerned, it will not buy the products that you will be selling much.

Therefore, it is your responsibility to ensure that they live up to it.? Here are five ways to ensure you are managing your partners appropriately.

Report: Tuscaloosa County homeowners sue insurance companies over tornado coverage

BIRMINGHAM, Alabama -- Dozens of homeowners in Tuscaloosa County have sued their insurance company over how much they offered to pay after the April 2011 tornadoes greatly damaged the area, according to a report by the Tuscaloosa News.

In one case, two dozen people are in a class action lawsuit filed last month against Cotton States Insurance. There have been 13 suits filed in the county since the April 2011 tornadoes, representing 39 plaintiffs.

According to the report, other suits have been filed against State Farm, Access Insurance, Met Life, Baldwin Mutual, Foremost Insurance, Nationwide and Allstate.

Hilary Duff's "Not Stressed" About Losing Baby Weight!

Unlike most Hollywood moms who start dieting the second their baby pops out, Hilary Duff is taking a more realistic approach. "I try to eat organic, but I?m not a total freak about it," the new mom to 2-month-old Luca told In Touch at a recent Johnson & Johnson event in LA. "I eat a lot of protein and a lot of fruits and vegetables."

However, Hilary and her husband, Mike Comrie, aren't willing to give up indulging entirely, either. "When we go out to restaurants, we want to order naughty food and enjoy it," Hilary, 24, revealed.

But as far as exercise, she is seriously working up a sweat doing a mix of SoulCycle, Pilates and circuit training with her fitness guru, Harley Pasternak. "I?m not stressing about it. I?m working out hard, but I know I?m not going to see results until I?m eating really good," she explains.

Regular readers will know that the FCC is a bit of a virtual whistle-blower, alerting tech-hungry Americans to when new goodies might soon be landing on their shores. Other times it coughs up the odd thing we weren't even waiting for. Today's offering appears to be a 3G tablet from NEC. There's little in the way of specification, or even pictures, but we do know it's sporting GSM and HSPA radios along with the standard WiFi. The device measures 222.6 mm across, which strongly points to a display somewhere in the 7-inch region. The KMP7R4D1-1A model number isn't ringing any bells right now, but we do remember a few Japanese models that bear a passing resemblance not that long ago.
